By accessing the website at www.lincolnchamber.ca, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trademark law.

2. USE LICENSE

a. Permission is granted to temporarily download one copy of the materials (information or software) on Lincoln Chamber of Commerce website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

i. modify or copy the materials;

The Lincoln Chamber of Commerce (“Lincoln Chamber,” “we,” “our,” or “us”) is committed to protecting the privacy and confidentiality of personal information entrusted to us by our members, event attendees, customers, volunteers, website visitors, and other individuals with whom we interact. 

This Privacy Policy outlines how we collect, use, disclose, retain, safeguard, and provide access to personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and its ten fair information principles. 

1. Accountability 

The Lincoln Chamber of Commerce is responsible for personal information under its control and has designated a Privacy Officer to oversee compliance with this policy and applicable privacy legislation.

The Privacy Officer is responsible for overseeing the organization’s privacy practices, responding to privacy-related inquiries and complaints, coordinating access requests, and overseeing the organization’s response to privacy breaches or other privacy concerns. 

2. Identifying Purposes 

Before or at the time personal information is collected, we will identify the purposes for which it is being collected. 

Depending on the nature of the interaction, personal information may be collected for purposes including: 

  • administering Chamber memberships and accounts; 
  • processing registrations, payments, and participation in Chamber events and programs; 
  • communicating with members, event participants, and other contacts; 
  • providing member benefits, services, resources, and information; 
  • distributing newsletters, announcements, and other Chamber communications where consent or another lawful basis permits; 
  • administering awards, programs, sponsorships, and other Chamber initiatives; 
  • responding to inquiries and providing customer service; 
  • maintaining business and administrative records; 
  • improving our programs, services, communications, and website; and 
  • meeting legal, regulatory, accounting, or other legitimate organizational requirements. 

We will not use personal information for a new purpose that is not reasonably compatible with the original purpose without obtaining consent, unless otherwise permitted or required by law. 

3. Consent 

We will obtain an individual’s knowledge and consent for the collection, use, or disclosure of personal information, except where consent is not required or would be inappropriate under applicable law. 

Consent may be express or implied depending on the circumstances and the sensitivity of the information involved. 

Individuals may withdraw their consent at any time, subject to legal or contractual restrictions and reasonable notice. Withdrawal of consent may affect our ability to provide certain services or fulfill certain requests. 

Where we send commercial electronic messages, we will comply with applicable requirements under Canada’s anti-spam legislation. 

4. Limiting Collection 

We will limit the collection of personal information to information that is necessary for the purposes identified to the individual. 

We will collect personal information by fair and lawful means and, where appropriate, with the knowledge and consent of the individual. 

We will not collect personal information indiscriminately or collect information that is not reasonably required for the purpose for which it is being obtained. 

5. Limiting Use, Disclosure, and Retention 

Personal information will only be used or disclosed for the purposes for which it was collected, for other purposes to which the individual has consented, or where otherwise permitted or required by law. 

We may disclose personal information to service providers or other third parties where necessary to provide a requested service or operate our programs and systems. Where appropriate, we take reasonable steps to ensure that such parties protect personal information in accordance with applicable privacy requirements. 

We will not sell or rent personal information. 

Personal information will be retained only for as long as reasonably necessary to fulfill the identified purposes, meet legal or accounting requirements, resolve disputes, or otherwise satisfy legitimate business or organizational needs. When personal information is no longer required, it will be securely destroyed, erased, or anonymized, as appropriate. 

6. Accuracy 

We will make reasonable efforts to ensure that personal information in our possession is accurate, complete, and up to date for the purposes for which it is being used. 

Individuals may request that inaccurate or incomplete personal information be corrected. Where appropriate, we will make reasonable efforts to update the information and communicate relevant corrections to third parties to whom the information has been disclosed. 

7. Safeguards 

We will protect personal information through reasonable physical, administrative, and technological safeguards appropriate to the sensitivity of the information. 

Safeguards may include: 

  • limiting access to personal information to individuals who require it for legitimate organizational purposes; 
  • using password protection and access controls; 
  • taking reasonable measures to protect electronic and physical records; 
  • securely storing and disposing of personal information; 
  • providing privacy and security guidance to staff and others who handle personal information; and 
  • taking reasonable steps to prevent unauthorized access, collection, use, disclosure, copying, modification, loss, or theft of personal information. 

In the event of a privacy breach, we will assess the circumstances and take reasonable steps to contain the breach, reduce potential harm, notify affected individuals and other parties where required, and prevent a recurrence. 

8. Openness 

We will make information about our privacy practices readily available to individuals. 

This Privacy Policy is available publicly and describes: 

  • the types of personal information we collect; 
  • the purposes for which personal information is collected, used, or disclosed; 
  • how individuals may access or correct their personal information; 
  • how individuals may withdraw consent where applicable; and

Individuals may contact our Privacy Officer for additional information about our privacy practices. 

9. Individual Access 

Upon request, an individual may ask whether we hold personal information about them and, where applicable, request access to that information. 

Subject to applicable legal exceptions, we will provide access to personal information in our custody or control and information about how it has been used or disclosed. 

Individuals may also request that inaccurate or incomplete information be corrected. 

Requests for access or correction should be directed to our Privacy Officer at info@lincolnchamber.ca. 

We will respond to requests within the time required by applicable privacy legislation and may require sufficient information to verify the identity of the individual making the request. 

10. Challenging Compliance 

Individuals may raise questions or concerns about our compliance with this Privacy Policy or applicable privacy legislation by contacting our Privacy Officer. 

The Privacy Officer will review and investigate privacy complaints and will communicate the outcome to the individual, subject to applicable legal and confidentiality requirements. 

If an individual is not satisfied with the response, they may have the right to make a complaint to the Office of the Privacy Commissioner of Canada or another applicable privacy oversight body. 

Membership List Confidentiality 

The Lincoln Chamber of Commerce is committed to protecting the confidentiality of information relating to our members. 

We will not sell or rent our membership list or members’ personal information to third parties for commercial or marketing purposes. 

Membership information will only be used for legitimate Chamber-related purposes or disclosed where: 

  • the member has provided consent; 
  • the disclosure is necessary to provide a requested service or benefit; 
  • the disclosure is otherwise permitted by applicable law; or 
  • the disclosure is required by law. 

Certain business information may be publicly displayed in our membership directory or other Chamber communications where the member has provided or authorized that information for publication. Individuals may contact the Chamber to request correction or removal of personal information from publicly available Chamber materials, subject to applicable requirements and legitimate organizational purposes. 

Changes to This Policy 

The Lincoln Chamber of Commerce may update this Privacy Policy from time to time to reflect changes to our practices, services, or applicable privacy legislation.
